New ADA Regulations and Standards
 
On Monday evening, July 26, the DOJ published new ADA Regulations and adopted the new Standards on their website. The revised regulations will amend the Department's Title II regulation, 28 C.F.R. Part 35, and the Title III regulation, 28 C.F.R. Part 36. Appendix A to each regulation includes a section by section analysis of the rule and responses to public comments on the proposed rule. Appendix B to the Title III regulation discusses major changes in the ADA Standards for Accessible Design and responds to public comments received on the proposed rules. When they are published in the Federal Register (likely next week), the clock will begin running on their staged effective dates. 
 
The Department of Justice has adopted the Access Board's 2004 Guidelines as the new Standards with only a few changes.
